Terms of Service

These Terms of Service ("Terms") govern your use of the website operated by PumMail Landscaping & Lawn Care, LLC and the landscaping, lawn care, hardscaping, and snow removal services we provide. By using our website or services you agree to these Terms.

1. Service contracts

Recurring services (lawn care programs, mowing, snow removal) are sold as written annual or seasonal contracts. The contract governs scope, schedule, price, and cancellation. These Terms supplement, but do not replace, the contract.

2. Estimates & pricing

Estimates are valid for 30 days. Prices are based on observed property conditions; if conditions differ materially (e.g. access blocked, dog waste, severe debris) we may adjust the quote with written notice before continuing.

3. Payment

Invoices are due within 15 days. Late balances over 30 days accrue 1.5% monthly interest. Returned-payment fee is $35.

4. Cancellation

Annual contracts may be cancelled at any time with 30 days written notice. Pre-paid amounts are prorated and refunded.

5. Property access & safety

You are responsible for providing access (gates, codes) and disclosing irrigation heads, invisible-fence wires, or other hidden hazards. We are not liable for damage to undisclosed buried utilities or unmarked items.

6. Weather & delays

We may reschedule for weather, equipment failure, or safety. We communicate delays by text or email the morning of.

7. Warranty

Hardscape installations carry a 5-year workmanship warranty. Plant material installed by us carries a 1-year health warranty when watered to spec. Lawn treatments are guaranteed within their labeled re-application window.

8. Limitation of liability

To the maximum extent permitted by NY law, our total liability arising from any service is limited to the amount you paid for that service in the prior 12 months. We disclaim incidental and consequential damages.

9. Governing law

These Terms are governed by the laws of New York State. Disputes will be resolved in the courts of Schenectady County.
